Who these terms are between

These terms are between Abdul Wahab Bostani, known as Arman Bostani, trading as Strathmark, of 48 West George Street, Glasgow G2 1BP, and the business that subscribes to Strathmark Fit-Out. In them "I" means Abdul Wahab Bostani trading as Strathmark and "you" means your business. Strathmark Fit-Out is sold to businesses only, so by subscribing you confirm that you are acting for a business and not as a consumer.

What you get

Every Monday I email you the commercial building warrants that the councils I cover validated in the previous week and that look relevant to the trade you chose, with a spreadsheet of the same records. Each record has its council reference, the date it was validated, the site address and the proposal in the council's own words. If a week has nothing for your trade, the email says so. When Monday is a public holiday, the list may arrive on the next working day.

The records

I take the records from the weekly lists on those councils' public building standards registers, and I check every list before it goes out. The registers belong to the councils, so I can't promise that they are complete or free of errors, and a warrant doesn't mean the work is out to tender or still available. Which trades a record is sent to is my judgement. Check the council reference before you rely on a record, and bear in mind that other firms can find the same public records.

Price and payment

Strathmark Fit-Out costs £149 a month. Stripe takes the payment by card on the day you subscribe and on the same date each month after that. No VAT is added, because Strathmark is not registered for VAT. If the price ever changes, I will email you at least 30 days before the new price applies, and you can cancel before then.

Cancelling

You can cancel at any time, through the billing link in your welcome email or by replying "cancel" to any Strathmark email. Cancelling stops future payments, and your lists carry on until the end of the month you have already paid for. There is no notice period and no cancellation fee.

First-month refund

If the first month isn't worth it to you, tell me before your second payment is taken and I will refund the first payment in full. After that, payments already made are not refunded, unless I failed to send the lists you paid for or the law says otherwise.

Using the lists

The lists are for your own business, and you can share them with the people who work for it. Please don't resell or publish them.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law doesn't allow to be limited. Apart from that, my total liability to you for anything connected with Strathmark Fit-Out in any 12 months is limited to the fees you paid in those 12 months, and I am not liable for lost profits or lost contracts.

Personal data

How I handle personal data is set out in the privacy notice. The lists leave out the names of private individuals. If you contact anyone connected with a record, such as the agent, you are responsible for doing so lawfully.

Changes to these terms

I will email you at least 30 days before any change to these terms takes effect. If you don't want to continue on the new terms, you can cancel before they start.

Law

These terms are governed by the law of Scotland, and the Scottish courts deal with any dispute.
